TERMS AND CONDITIONS

1. In buying from or placing an order with Ellie Misner, you agree that the following terms and conditions apply to your order or purchase.

2. Your agreement to buy is with Ellie Misner and you undertake that all information you provide is wholly accurate and correct, and that you have sufficient funds to cover payment of the garments.

3. You agree that your email address is the contact information to be used in connection with any order placed.

4. While every care has been taken to ensure that any garments on the website are displayed as accurately as possible, the actual colours or appearance of any fabric you see may depend on the device you use to access the website/ view items via a third-party website, and we cannot therefore guarantee this may reflect the true colour or appearance of the fabric of the item on delivery.

5. We are not responsible for any content accessed as a link from this website nor do we endorse any content, products or services unless specifically stated.

6. All garments are subject to availability and prices are displayed in pounds sterling (£ GB).

7. Any import duties or taxes or any similar charges imposed on delivery to an international destination are the sole responsibility of the client.

8. Ellie Misner does not accept any liability for the garments once they have been dispatched.

9. We hope you will love your purchase. However, if you are not completely satisfied, we are happy to examine the garment for correction of any fault provided the garment is returned to us at your expense within 30 days of dispatch.

10. Refunds will only be given if the garment is faulty and provided there is a fault which is not attributable to the mishandling, wear or misuse of the item by the client. No refund is payable for normal wear and tear. 

11. Any returns must be in the same condition as received, unworn, unwashed with tags attached and in the original packing.

 

CUSTOM ORDERS

 

1. An initial deposit of 50% of the price (‘the Initial Deposit’) is required for any order for a custom garment. This deposit is due and payable in full within 3 days of issue of the client’s invoice.

2. If the custom order has been confirmed by the client, even though the client chose to proceed without attending an in-person fitting, the Initial Deposit is non-refundable in any circumstances.

3. The balancing payment of 50% of the custom order (‘the Balance’) is due and payable in full on receipt of the final invoice and for the avoidance of doubt, all garments must be paid for in full before dispatch.

4. All legal ownership of the garments is retained by Ellie Misner until payment of both the Initial Deposit and the Balance has been made in full.

 

GENERAL

 

1. To the extent permitted by law, Ellie Misner gives no warranties in relation to the website or regarding the accuracy of any descriptions and illustrations of items.

2. All intellectual property rights including copyright in any sketches, designs, drawings or other information created for a custom item are reserved to Ellie Misner on a worldwide basis.

3. Any variation of these terms shall be in writing.

4. If any provision of these terms is held to be invalid for whatever reason, it shall be regarded as separate to the rest of these terms which shall remain in effect.

5. These terms and conditions are governed exclusively by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.
